These Terms of Service ("Terms") govern your use of the Build Better website and any services provided by Build Better ("we", "us", "our"). By accessing our website or engaging our services, you agree to these Terms.
1. About Build Better
Build Better provides strategy, campaigns, creator management, content production, events, operations support, consulting, and related growth services for brands, organisations, and businesses.
2. Use of Website
You agree to use our website only for lawful purposes and in a way that does not:
Violate any applicable laws or regulations
Infringe the rights of others
Disrupt website functionality or security
Attempt unauthorised access to systems or data
Submit false, misleading, or harmful information
We may suspend or restrict access if misuse occurs.
3. Enquiries and Proposals
Submitting an enquiry, booking a call, or requesting a proposal does not create a client relationship. A binding relationship begins only when both parties agree in writing to the scope of work.
Any proposal, estimate, timeline, or pricing provided is subject to review and may change until formally accepted.
4. Services and Scope
All services are delivered according to the agreed proposal, statement of work, invoice, contract, or written confirmation.
Changes outside the agreed scope may require:
revised timelines
additional fees
updated deliverables
separate approval
We are not responsible for delays caused by missing approvals, delayed feedback, unavailable assets, or third-party platforms.
5. Client Responsibilities
Clients agree to provide, where relevant:
accurate project information
timely feedback and approvals
access to required accounts or systems
lawful ownership or permission for supplied content
cooperation necessary to complete the work
Delays in client responses may affect delivery timelines.
6. Fees and Payment
Fees, deposits, retainers, milestones, and payment dates will be stated in writing.
Unless otherwise agreed:
invoices are payable within the stated payment period
late payments may delay work delivery
completed work may be withheld until payment is received
deposits or setup fees may be non-refundable once work begins
The client is responsible for applicable taxes unless stated otherwise.
7. Intellectual Property
Unless otherwise agreed in writing:
Build Better retains ownership of its processes, frameworks, templates, proposals, and pre-existing materials
Final paid deliverables created specifically for the client may be licensed or assigned as agreed
Third-party assets remain subject to their own licences
Clients warrant they have rights to any materials they provide to us.
8. Marketing and Case Studies
Unless restricted in writing, Build Better may reference completed work in portfolios, proposals, and case studies, including public-facing results, logos, or project summaries.
Confidential information will not be disclosed without permission.
9. Confidentiality
Both parties agree to keep confidential non-public business information shared during a project, except where disclosure is required by law.
10. Third-Party Platforms
Many services depend on third-party tools or platforms such as social media networks, ad platforms, CMS providers, email tools, hosting providers, or creator platforms.
We are not liable for outages, bans, algorithm changes, account restrictions, policy changes, or platform decisions outside our control.
11. No Guaranteed Results
We apply skill, experience, and reasonable care, but we do not guarantee specific outcomes such as:
revenue increases
follower growth
rankings
donations
leads
conversions
media coverage
Performance depends on many external factors.
12. Limitation of Liability
To the maximum extent permitted by law, Build Better will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of our website or services.
Our total liability relating to any claim will not exceed the amount paid to us for the relevant services giving rise to that claim.
13. Termination
Either party may end a project subject to written notice and any agreed contractual terms.
The client remains responsible for payment for work completed, committed costs, and approved expenses up to termination date.
14. Website Content Disclaimer
Website content is for general information only and may be updated without notice. We do not guarantee that all website content is always complete, current, or error-free.
15. Governing Law
These Terms shall be governed by the laws of the applicable jurisdiction agreed with the client, or where no agreement exists, the jurisdiction in which Build Better primarily operates.
16. Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date.
